Act on Mediation in Criminal and Certain Civil Cases
(1015/2005)
Chapter 1 — General provisions
Section 1 — Scope of application
(1) For the purposes of this Act, mediation in criminal cases (mediation) means a non-chargeable service in which a crime suspect and the victim of that crime are provided the opportunity to meet confidentially through an independent conciliator, to discuss the mental and material harm caused to the victim by the crime and, on their own initiative, to agree on measures to redress the harm.
(2) Mediation may also be used in civil cases in which at least one of the parties is a natural person. Civil cases other than those concerning claims for damages based on a crime may, however, only be referred to mediation if the dispute is of a minor nature, taking into account the subject and the claims put forward in the case. What is provided on mediation in criminal cases in this Act applies, as appropriate, to mediation in civil cases.
Section 2 — General conditions for mediation
(1) Mediation may be carried out only between parties that have personally and voluntarily expressed their agreement to mediation and are capable of understanding the meaning of mediation and the solutions arrived at in the mediation process. Before the parties agree to mediation, they must be explained their rights in relation to mediation and their position in the mediation process. Each party has the right to withdraw its agreement at any time during the mediation process.
(2) Underage persons must give their agreement to mediation in person. In addition, an underage person’s participation in mediation requires that his/her custodian or other legal representatives agree to it. Legally incompetent adults may participate in mediation if they understand the meaning of the case and give their personal agreement to mediation.
Section 3 — Issues dealt with through mediation
(1) Mediation may deal with crimes that are assessed as eligible for mediation, taking into account the nature and method of the offence, the relationship between the suspect and the victim and other issues related to the crime as a whole. Crimes involving underage victims must not be referred to mediation if the victim needs special protection because of the nature of the crime or because of his/her age. If a crime cannot be referred to mediation, issues related to compensation of the damage caused by it must not be referred to mediation either.
(2) Civil cases may be referred to mediation if dealing with them through mediation can be considered expedient.
(3) Even if a case is dealt with and decided by a police or prosecuting authority or in a court of law, this does not preclude mediation.
Section 4 — Definitions
For the purposes of this Act:
1) mediation office means an operating unit with the duty of providing mediation services in a particular area under section 8;
2) conciliator means a person with appropriate training who handles individual mediation duties under the supervision and monitoring of the mediation office;
3) person in charge of mediation services (co-ordinator) means a person whose duty it is to be responsible for planning, developing and appropriately implementing mediation services within the operating area of the mediation office and of acting as conciliator where necessary; and
4) mediation advisor means a person with the duty of supervising and monitoring the work of the conciliators and acting as conciliator where necessary.
Chapter 2 — Arrangement of mediation and compensation of expenses
Section 5 — General management, supervision and monitoring
The general management, supervision and monitoring of mediation services fall within the jurisdiction of the Ministry of Social Affairs and Health.
Section 6 — Advisory board on mediation in criminal cases
The advisory board on mediation in criminal cases, appointed for a period of three years at a time by the Government for the purposes of national supervision, monitoring and development of mediation services, acts under the auspices of the Ministry of Social Affairs and Health, and further provisions on its duties and composition are laid down by Government decree.
Section 7 — Obligation to provide services
Each State Provincial Office is obliged to arrange mediation services and ensure that they are available in appropriately implemented form in all parts of the province.
Section 8 — Service provision
(1) In arranging the provision of mediation services, the State Provincial Office may make: 1) a commission agreement referred to in section 2(2) of the Local Government Act (365/1995) with the municipality concerned, under which the municipality undertakes to ensure that the service is provided within its own area or, in addition, in the areas of other municipalities or parts thereof as agreed under section 9; or
2) an agreement with some other public or private service provider under which the service provider undertakes to ensure that the service is provided in an area agreed on under section 9.
(2) If the services cannot be provided in a certain area under subsection 1, the State Provincial Office concerned must provide the services in that area with the help of hired personnel or in some other manner it considers appropriate.
Section 9 — Agreement on service provision
An agreement on the provision of mediation services must include agreement on at least:
1) the area in which the service referred to in the agreement is arranged;
2) the amount of compensation payable from government funds in compliance with the grounds laid down in section 12(3) and the payment of the compensation;
3) the person in charge of mediation services, the other personnel in the mediation office and the number of conciliators;
4) the training arranged for persons involved in mediation;
5) the duration of the agreement; and 6) the termination of the agreement.
Section 10 — Competence requirements for persons engaged in the provision of mediation services
(1) Persons in charge of mediation services and mediation advisors must have an appropriate academic degree. If there is a special reason, other persons with good knowledge of mediation services and of related planning and supervision may be accepted for these duties. Persons who have completed introductory training in mediation services and otherwise have the education, skill and experience required for the appropriate handling of the duties may also act as conciliators.
(2) Further provisions on the competence requirements for persons referred to in subsection 1 may be given by Government decree.
Section 11 — Provision of further training
The State Provincial Offices must ensure that further training for persons engaged in the provision of mediation services nationally and regionally is provided.
Section 12 — Compensation from government funds
(1) Expenses incurred in arranging mediation services are compensated from government funds. The aggregate amount of compensation payable from government funds is confirmed annually at a level which corresponds to the average expenses estimated to arise from maintaining mediation offices, appropriate service provision and training for persons engaged in the provision of mediation services.
(2) The aggregate amount of compensation is divided among the State Provincial Offices for use in covering expenses referred to in subsection 1. The division is based on the number of inhabitants, the surface area and the crime situation in each province.
(3) Service providers are entitled to receive compensation payable from government funds on the basis of calculation criteria to cover their expenses referred to in subsection 1. The amount of compensation is determined on the basis of the number of inhabitants, the surface area and the crime situation in the service provider’s operating area.
(4) Further provisions on the division of compensation referred to in subsection 2, on determining the compensation referred to in subsection 3 and on payment of the compensation to the State Provincial Offices in cases referred to in section 8(2) are given by Government decree.
Chapter 3 — Mediation procedure
Section 13 — Referral to mediation
(1) Mediation may be proposed by the crime suspect, the victim, the police or prosecuting authority or some other authority. If the suspect or the victim is underage, his/her custodian or other legal representative has the right to propose mediation. In cases involving a legally incompetent adult, the person supervising his/her interests may also propose mediation.
(2) However, only the police or prosecuting authority has the right to propose mediation if the crime involves violence that has been directed at the suspect’s spouse, child, parent or other comparable near relation.
(3) When the police or prosecuting authority assesses that a case at hand is eligible for mediation as laid down in section 3(1), it must inform the suspect and the victim of the crime of the possibility of mediation and refer them to mediation, unless otherwise provided in subsection 2 of this section. If the suspect or the victim of the crime is underage, the information on the possibility of mediation must also be given to his/her custodian or other legal representative. In cases involving a legally incompetent adult, the information must always be given to both the person him/herself and the person looking after his/her interests.
Section 14 — Place of mediation
(1) Proposals concerning mediation are processed by the mediation office in whose area one of the parties lives and in which the mediation can take place flexibly, giving due consideration to the circumstances of the partners. Proposals may also be processed by the office in whose area the crime has taken place.
(2) Parties can always submit a proposal concerning mediation to the mediation office in whose area they live. If the mediation office receiving the proposal decides not to deal with it, it must transfer the case without delay to an office it deems suitable for processing the proposal under subsection 1.
(3) If no agreement is reached between mediation offices in the matter of deciding which of the offices referred to in subsection 1 will process the mediation proposal, the proposal shall be processed by a mediation office designated by the State Provincial Office, provided that the mediation offices are located in the same province. If the mediation offices are located in different provinces, the designation will be made by the Ministry of Social Affairs and Health.
Section 15 — Investigating the conditions for mediation and deciding on mediation
Before deciding to start mediation, the mediation office must ensure that the conditions for mediation laid down in section 2 are fulfilled and must assess the eligibility of the case for mediation. If the case concerned is a civil case, the mediation office must also assess whether it is expedient to resort to mediation. The person in charge of mediation services in the mediation office decides on whether to accept a case for mediation.
Section 16 — Duties of the mediation office in connection with the mediation procedure
When a mediation office accepts a case for mediation, it must:
1) nominate a conciliator for the mediation process who is suitable for the task on the basis of his/her experience and personal characteristics and is not disqualified in the manner referred to in the Administrative Procedure Act (434/2003);
2) with the relevant parties’ agreement, obtain documents necessary for mediation from the police or prosecuting authority, courts of law or other parties;
3) ensure the provision of an interpreter or translator if a party does not have a command of the language to be used in mediation or because of a sensory or speech defect or some other reason cannot understand the discussions held in the mediation process or be understood in it; and
4) after mediation, inform the police or prosecuting authority of the mediation process and its outcome, notwithstanding the provisions on secrecy.
Section 17 — Duties of the conciliator
Conciliators must:
1) arrange mediation meetings between the parties;
2) conduct the mediation without bias and respecting all parties;
3) help the parties to find mutually satisfactory solutions concerning the crime in order to redress the mental and material harm the victim has suffered because of the crime;
4) give the parties information on available legal assistance and other services;
5) draw up a document on the agreement reached by the parties in the mediation process and verify it with a signature; and 6) after mediation, submit a report on the mediation process to the mediation office.
Section 18 — Arrangement of mediation
(1) Mediation takes place without an audience. The parties must participate in the mediation process in person. In mediation meetings, the parties are allowed to use assistants or support persons if this does not endanger the undisturbed progress of the mediation process. If one of the parties is underage, the mediation must be arranged in a way that allows the person the opportunity to receive support from his/her custodian or other legal representative. The presence of a custodian or some other legal representative in mediation meetings can be prohibited only if it is clearly against the interests of the underage person. Custodians or other legal representatives of parties under 15 years of age cannot, however, be prohibited from participating in mediation meetings.
(2) If agreement on the participation of an assistant, a support person or a custodian or legal representative of an underage person in the mediation process cannot be reached between the conciliator, the parties to the mediation process and the legal representative of the underage person, the matter will be decided by the person in charge of mediation services in the mediation office.
(3) Conciliators may also arrange mediation meetings with one party in the absence of other parties, provided that all parties agree to this.
Section 19 — Interruption of mediation
(1) Mediation offices must interrupt mediation immediately if a party withdraws its agreement or if there is reason to suspect that the agreement has not been given voluntarily. Mediation must also be interrupted if there is a justified reason to suspect that a party to the mediation process cannot understand the meaning of mediation and the solutions to be made in the process or if continuation of the mediation process is clearly against the interests of a party that is underage.
(2) Mediation offices may interrupt mediation if, for reasons other than those referred to in subsection 1, it emerges that there is no basis for successful mediation.
Section 20 — Secrecy and the confidentiality obligation
(1) The provisions of the Act on the Openness of Government Activities (621/1999) apply to the publicity of documents held by conciliators or mediation offices and to the confidentiality obligation of mediation office personnel or other persons participating in the handling of mediation cases.
(2) Notwithstanding provisions of section 14 of the Act on the Openness of Government Activities, mediation offices shall decide on access to information contained in documents that are held by the conciliator or the mediation office. The provisions of section 29 of the Act on the Openness of Government Activities apply to the right of mediation offices to grant State Provincial Offices access to information contained in secret documents.
(3) In mediation offices, the person in charge of mediation services shall decide on issues referred to in this section. The provisions of section 33 of the Act on the Openness of Government Activities apply to appeals concerning such decisions.
Chapter 4 — Miscellaneous provisions
Section 21 — Prohibition on testifying and on referring to information (1) Conciliators must not testify about anything they have learnt in their duties concerning a mediation case unless particularly weighty reasons require the questioning of a conciliator.
(2) In later phases of dealing with a case, a party to the mediation process must not, without the consent of the other party, refer to what the latter has presented during the process in order to reach agreement.
Section 22 — Dealing with disputes concerning agreements made on the arrangement of mediation
Disputes concerning agreements on the arrangement of mediation made in accordance with section 9 are dealt with as administrative litigation cases by an administrative court as provided in the Administrative Judicial Procedure Act (586/1996).
Section 23 — Appeals
Appeals against decisions made by State Provincial Offices or the Ministry of Social Affairs and Health under section 14(3) and by mediation offices under section 15(1), 18(2) or 19 are submitted to an administrative court as provided in the Administrative Judicial Procedure Act.
Section 24 — Mediation officés notification obligation
A mediation office must, without delay, notify the police or prosecuting authority of a decision by which it has refused to accept a case for mediation or has interrupted the mediation.
Section 25 — Non-chargeability of documents obtained for mediation
Mediation offices are entitled to obtain documents necessary for mediation from police and prosecuting authorities and courts of law free of charge.
Section 26 — Entry into force
(1) This Act enters into force on 1 January 2006.
(2) Services referred to in this Act must be arranged in accordance with section 7 and provided in accordance with section 8 as of 1 June 2006.
(3) Measures necessary for the implementation of the Act may be undertaken before the Act’s entry into force

Act on Court-annexed Mediation

Chapter 1 — General provisions
Section 1 — Scope of application
Civil matters and contested petitionary matters before the general courts may be mediated as provided in this Act (court-annexed mediation).
Section 2 — Objective of court-annexed mediation
The objective of court-annexed mediation is an amicable settlement of the matter.
Section 3 — Preconditions for court-annexed mediation
The preconditions for court-annexed mediation are that the matter is amenable to mediation and that the mediation is appropriate in view of the claims of the parties.
Chapter 2 — Procedure
Section 4 — Commencement of court-annexed mediation
(1) In a dispute not pending before a court, court-annexed mediation may be commenced on the written application of a party or both parties.
The application shall be filed in writing, indicating what is the subjectmatter of the dispute and how the positions of the parties diverge. In addition, grounds shall be supplied for the matter being amenable to mediation. The application shall identify the parties and contain their contact details observing, in so far as appropriate, the provisions on an application for a summons in chapter 5, section 2(2), of the Code of Judicial Procedure (oikeudenkäymiskaari).
(2) In a matter pending before a court, court-annexed mediation may be commenced on the request of a party or both parties. The request may be made without formalities, and it must be made before the preparation of the case has been concluded.
(3) The commencement of court-annexed mediation requires the consent of all parties. A request or application for mediation not filed by the parties together shall be served on the other parties in a suitable manner and they shall be reserved an opportunity to be heard on the request or application. The hearing may take place orally or in writing.
(4) The court shall decide on the commencement of court-annexed mediation.
Section 5 — Mediator and auxiliary
(1) A mediator shall be designated for the matter. The mediator shall be a judge in the court where the case is pending.
(2) In order to secure the expertise necessary in the matter or otherwise to further the mediation, the mediator may have an auxiliary if the parties consent to the same. The mediator shall appoint the auxiliary once the parties have accepted the nominee. The fee of the auxiliary shall be paid and his or her expenses reimbursed by the parties.
Section 6 — Proceedings
(1) Court-annexed mediation shall proceed promptly, even-handedly and impartially.
(2) The mediator shall hear the parties and consult with them. With the consent of the parties, also other persons may be heard and other information submitted.
(3) The mediator may consult with a party without the other parties present, if all parties consent to the same.
(4) After consultation with the parties, the mediator shall decide on the detailed arrangements of the mediation.
Section 7 — Reaching a settlement
(1) The mediator shall assist the parties in their endeavours towards agreement and an amicable settlement.
(2) On the request or with the consent of the parties, the mediator may make a settlement proposal. The mediator may make the proposal ex æquo et bono.
Section 8 — Certification of a settlement
(1)A settlement accepted by the parties may be certified in court-annexed mediation.
(2) The settlement and the certification of the settlement shall be governed by the corresponding statutory provisions on a settlement in court.
However, a settlement certified in court-annexed mediation may cover also issues not mentioned in the parties’ original claims.
Section 9 — Conclusion of court-annexed mediation
(1) Court-annexed mediation shall be concluded, if
(1) a settlement is certified or the parties notify the mediator of a settlement reached out of court;
(2) a party notifies the mediator that he or she no longer wishes to have mediation in the matter; or
(2) the mediator decides, after having heard the parties, that there is no justification for continuing the mediation.
(2) The mediator shall notify the parties of the conclusion of the mediation on the basis of paragraph (1)(2) or (1)(3).
(2) When court-annexed mediation in a matter that is also pending before the court is concluded on the basis of paragraph (1)(2) or (1)(3), the proceedings in the matter shall be resumed in accordance with the provisions on regular civil procedure.
Chapter 3 — Miscellaneous provisions
Section 10 — Jurisdiction
(1)Jurisdiction over court-annexed mediation shall lie with the court that has jurisdiction over the matter for purposes of court proceedings.
(2) The court is competent in respect of the commencement of courtannexed mediation and of the mediation with the composition competent to make decisions relating to the preparation of the case.
Section 11 — Representation
(1) The representation of the parties in court-annexed mediation shall be governed by the statutory provisions on the exercise of a party’s right to be heard in court.
(2) The right of a party to counsel or representation by an attorney, as well as the qualification of counsel and attorneys, shall be governed by the provisions on counsel and attorneys in civil proceedings. However, in order to further the mediation, the mediator may on a justified reason supplied by a party allow a person to serve as counsel or attorney even if that person does not have a degree referred to in chapter 15, section 2, of the Code of Judicial Procedure, provided that he or she is not bankrupt and that his or her legal competency has not been restricted.
Section 12 — Openness of proceedings
Court-annexed mediation, the documents relating to it and the settlement shall be subject to the provisions of the Act on the Publicity of Court Proceedings (945/1984; laki oikeudenkäynnin julkisuudesta), in so far as appropriate. However, a session referred to in section 6(3) where the mediator consults with only one of the parties shall be closed to the public. At the request of a party, also other parts of the mediation shall be closed to the public, if the achievement of a settlement would otherwise be jeopardised and if the credibility of the mediation or some other weighty reason does not require that the proceedings be open.
Section 13 — Privilege
In any later proceedings, a party shall not without the consent of the other party rely on representations made by the other party in the interests of settlement.
Section 14 — Costs of court-annexed mediation
(1) The parties shall bear their own costs arising from court-annexed mediation.
(2) In any later proceedings, a party shall not require compensation from the opposing party for the costs of the mediation.
Section 15 — Disqualification of the mediator
(1) The provisions on the disqualification of a judge apply to the disqualification of the mediator and the auxiliary.
(2) The mediator shall not adjudicate in the same case.
Section 16 — Appeals
A court order on the commencement of mediation, on the rejection of a mediation request, or on the conclusion of mediation shall not be open to appeal.
Section 17 — Charges
The charges to be collected for the processing of an application or request for court-annexed mediation shall be governed by the Act on Service Charges in Courts and Certain Judicial Authorities (701/1993; laki tuomioistuinten ja eräiden oikeushallintoviranomaisten suoritteista perittävistä maksuista) and by the Decree issued on the basis of that Act.
Section 18 — Matters pertaining to the status or rights of a child
(1) Of the matters pertaining to the status or rights of a child, those pertaining to maintenance payable to a child or child custody and right of access are amenable to mediation under this Act. The mediation shall be carried out so that the interests of the child are secured. When considering whether a settlement can be certified, the court shall take due note of the provisions in the Child Custody and Right of Access Act (361/1983; laki lapsen huollosta ja tapaamisoikeudesta) and the Child Maintenance Act (704/1975; laki lapsen elatuksesta).
(2) A settlement certified in a matter referred to in paragraph (1) shall be considered equivalent to a court order or judgment in such a matter.
Section 19 — Relationship to other legislation
The provisions in other legislation on the reaching and certification of a settlement in court apply notwithstanding the provisions of this Act.
Section 20 — Entry into force
This Act enters into force on 1 January 2006.

Eduskunnan päätöksen mukaisesti säädetään:
1 luku
Yleiset säännökset
1 § Soveltamisala
Tätä lakia sovelletaan riita-asioiden ja riitaisten hakemusasioiden sovitteluun yleisessä tuomioistuimessa (tuomioistuinsovittelu).
Laissa säädetään lisäksi tuomioistuimen ulkopuolisessa sovittelussa tehdyn sovinnon vahvistamisesta täytäntöönpanokelpoiseksi.
Lain säännöksiä tuomioistuimen ulkopuolisessa sovittelussa tehdyn sovinnon vahvistamisesta täytäntöönpanokelpoiseksi sovelletaan myös muussa Euroopan unionin jäsenvaltiossa tuomioistuimen ulkopuolisessa sovittelussa tai tämän lain 2 luvun menettelyyn rinnastuvassa tuomioistuinsovittelussa tehtyyn sovintoon. Lain säännöksiä ei kuitenkaan sovelleta Tanskassa tehtyyn sovintoon tai sovintoon, joka ei koske tietyistä sovittelun näkökohdista siviili- ja kauppaoikeuden alalla annetussa Euroopan parlamentin ja neuvoston direktiivissä 2008/52/EY määriteltyä rajat ylittävää riitaa.
2 §
Suhde muihin säännöksiin
Jos muussa laissa on tästä laista poikkeavia säännöksiä sovittelusta tai sovitteluun liittyvästä seikasta, noudatetaan niitä tämän lain sijasta.

Tuomioistuinsovittelu
3§
Tuomioistuinsovittelun tavoite ja edellytykset
Tuomioistuinsovittelulla pyritään asian sovinnolliseen ratkaisuun.
Tuomioistuinsovittelun edellytyksenä on, että asia soveltuu soviteltavaksi ja sovittelu on tarkoituksenmukaista osapuolten vaatimuksiin nähden.
4 §
Tuomioistuinsovittelun aloittaminen
Asia, joka ei ole tuomioistuimessa oikeudenkäyntiasiana käsiteltävänä, voidaan ottaa soviteltavaksi riidan osapuolen tai osapuolten hakemuksesta. Hakemus on tehtävä kirjallisesti ja siinä on selostettava, mitä riita koskee ja miten osapuolten näkemykset eroavat toisistaan. Lisäksi tulee ilmoittaa perusteet, joilla asia soveltuisi soviteltavaksi. Hakemuksessa on ilmoitettava osapuolet ja heidän yhteystietonsa noudattaen soveltuvin osin, mitä oikeudenkäymiskaaren 5 luvun 2 §:n 2 momentissa säädetään haastehakemuksesta. Hakemuksessa voidaan myös pyytää tuomioistuimen tietyn tuomarin määräämistä sovittelijaksi.
Asia, joka on tuomioistuimessa oikeudenkäyntiasiana käsiteltävänä, voidaan osoittaa soviteltavaksi asianosaisen tai asianosaisten pyynnöstä. Pyyntö on vapaamuotoinen, ja se on tehtävä ennen kuin asian valmistelu on todettu päättyneeksi.
Sovittelun aloittaminen edellyttää kaikkien osapuolten suostumusta. Sovittelua koskeva pyyntö tai sellainen hakemus, jota eivät ole tehneet osapuolet yhdessä, on soveltuvalla tavalla annettava tiedoksi muille osapuolille ja heille on varattava tilaisuus tulla kuulluiksi pyynnön tai hakemuksen johdosta. Kuuleminen voi tapahtua suullisesti tai kirjallisesti.
Tuomioistuin päättää sovittelun aloittamisesta.
5 §
Sovittelija ja sovittelijan avustaja
Asiaa sovittelemaan määrätään sovittelija. Sovittelijana toimii asiaa käsittelevän tuomioistuimen tuomari.
Sovittelun kohteena olevassa asiassa tarvittavan asiantuntemuksen turvaamiseksi tai sovittelun edistämiseksi muuten sovittelija voi osapuolten suostumuksella käyttää avustajaa. Sovittelija nimeää avustajan saatuaan valinnalle osapuolten hyväksymisen. Avustajan palkkion ja korvauksen hänen kuluistaan suorittavat osapuolet.
6 §
Tuomioistuinsovittelun toteutus
Sovittelu on toteutettava joutuisasti sekä tasapuolisuutta ja puolueettomuutta noudattaen.
Sovittelijan tulee kuulla osapuolia ja neuvotella heidän kanssaan. Osapuolten suostumuksella voidaan kuulla muitakin henkilöitä ja esittää muuta selvitystä.
Sovittelija voi neuvotella osapuolen kanssa muiden osapuolten läsnä olematta, jos osapuolet tähän suostuvat.
Menettelyn muusta järjestämisestä sovittelija päättää osapuolten kanssa neuvoteltuaan.
7 §
Sovinnon aikaansaaminen
Sovittelijan tulee auttaa osapuolia heidän pyrkimyksessään päästä yhteisymmärrykseen ja sovinnolliseen ratkaisuun.
Osapuolten pyynnöstä tai suostumuksella sovittelija voi tehdä ehdotuksen asian sovinnolliseksi ratkaisemiseksi. Ehdotus voidaan perustaa siihen, minkä sovittelija osapuolten sovittelussa esiin tuomien seikkojen perusteella harkitsee tarkoituksenmukaiseksi.
8 §
Sovinnon vahvistaminen
Tuomioistuinsovittelussa tehdyn sovinnon vahvistamiseen ja sovintoon sovelletaan vastaavasti, mitä laissa säädetään sovinnosta oikeudenkäynnissä. Sovittelussa vahvistettava sovinto voi kuitenkin koskea myös muuta kuin osapuolten alkuperäisiä vaatimuksia.
9 §
Tuomioistuinsovittelun päättyminen
Tuomioistuinsovittelu päättyy, kun:
1) asiassa vahvistetaan sovinto tai osapuolet ilmoittavat sovittelijalle muuten sopineensa asian;
2) osapuoli ilmoittaa sovittelijalle, että ei halua asiaa enää soviteltavan; tai
3) sovittelija päättää osapuolia kuultuaan, että sovittelun jatkaminen ei ole enää perusteltua.
Sovittelun päättymisestä 1 momentin 2 ja 3 kohdan mukaisesti sovittelijan on ilmoitettava osapuolille.
Sovittelun päättyessä tuomioistuimessa myös oikeudenkäyntiasiana käsiteltävänä olevassa asiassa 1 momentin 2 tai 3 kohdan mukaisesti asian käsittelyä jatketaan riita-asian käsittelystä säädetyssä järjestyksessä.
10 §
Lapsen asemaa ja oikeutta koskevat asiat
Lapsen asemaa ja oikeutta koskevista asioista voidaan tuomioistuimessa sovitella niitä, jotka koskevat lapsen elatusta tai lapsen huoltoa ja tapaamisoikeutta. Tuomioistuinsovittelu on toteutettava siten, että lapsen etu turvataan. Harkitessaan, voidaanko sovinto vahvistaa, tuomioistuimen on otettava huomioon lapsen huollosta ja tapaamisoikeudesta annetun lain (361/1983) sekä lapsen elatuksesta annetun lain (704/1975) säännökset.
Sovinto, joka vahvistetaan 1 momentin mukaisesti sovitellussa asiassa, rinnastetaan tuomioistuimen päätökseen tai tuomioon näissä asioissa.
11 §
Toimivaltainen tuomioistuin
Asiaa sovittelemaan toimivaltainen on se tuomioistuin, joka on toimivaltainen käsittelemään asian oikeudenkäynnissä.
Tuomioistuin on päätösvaltainen tuomioistuinsovittelun aloittamista ja sovittelua koskevassa asiassa siinä kokoonpanossa, jossa tuomioistuin päättää asian valmisteluun liittyvistä toimista.
12 §
Tuomioistuinsovittelun julkisuus
Sovittelun, siinä käsiteltävien asiakirjojen ja sovinnon julkisuuteen sovelletaan soveltuvin osin, mitä oikeudenkäynnin julkisuudesta yleisissä tuomioistuimissa annetussa laissa (370/2007) säädetään. Yleisö ei kuitenkaan saa olla läsnä tämän lain 6 §:n 3 momentissa tarkoitetussa tilaisuudessa, jossa sovittelija neuvottelee vain toisen osapuolen kanssa. Lisäksi osapuolten pyynnöstä sovittelu voidaan toimittaa yleisön läsnä olematta, jos luottamus sovittelun asianmukaisuuteen tai muu painava syy ei edellytä asian julkista käsittelyä.
13 §
Salassapitovelvollisuus
Sovittelija tai sovittelijan avustaja ei saa ilmaista mitä hän tehtävässään on saanut tietää soviteltavasta asiasta, jollei se, jonka hyväksi vaitiolovelvollisuus on säädetty, anna suostumustaan tietojen ilmaisemiseen tai laissa muuta säädetä.
14 §
Sovittelijan esteellisyys
Sovittelijan ja hänen avustajansa esteellisyyteen sovelletaan, mitä tuomarin esteellisyydestä säädetään.
Sovittelija ei saa käsitellä tuomarina oikeudenkäynnissä asiaa, jossa hän on toiminut sovittelijana.
15 §
Osapuolten edustaminen
Osapuolten edustamiseen tuomioistuinsovittelussa sovelletaan, mitä laissa säädetään asianosaisen puhevallan käyttämisestä oikeudenkäynnissä.
Osapuolen oikeudesta käyttää tuomioistuinsovittelussa avustajaa ja asiamiestä sekä avustajan ja asiamiehen kelpoisuuteen sovelletaan, mitä laissa säädetään oikeudenkäyntiavustajasta ja -asiamiehestä riita-asiassa. Sovittelun edistämiseksi sovittelija voi osapuolen esittämästä perustellusta syystä kuitenkin hyväksyä tämän avustajaksi tai asiamieheksi muunkin kuin oikeudenkäymiskaaren 15 luvun 2 §:n 1 momentissa tarkoitetun henkilön, joka ei ole konkurssissa ja jonka toimintakelpoisuutta ei ole rajoitettu. L:lla 723/2011 muutettu 2 momentti tulee voimaan 1.1.2013. Aiempi sanamuoto kuuluu:
Osapuolen oikeuteen käyttää tuomioistuinsovittelussa avustajaa ja asiamiestä sekä avustajan ja asiamiehen kelpoisuuteen sovelletaan, mitä laissa säädetään oikeudenkäyntiavustajasta ja -asiamiehestä riita-asiassa. Sovittelun edistämiseksi sovittelija voi osapuolen esittämästä perustellusta syystä kuitenkin hyväksyä tämän avustajaksi tai asiamieheksi muunkin kuin oikeudenkäymiskaaren 15 luvun 2 §:ssä tarkoitetun tutkinnon suorittaneen henkilön, joka ei ole konkurssissa ja jonka toimintakelpoisuutta ei ole rajoitettu.
16 §
Vetoamiskielto
Osapuoli ei saa soviteltavana olleen asian myöhemmässä tuomioistuinkäsittelyssä ilman vastapuolen suostumusta vedota siihen, mitä tämä on sovintoon pääsemiseksi tuomioistuinsovittelussa esittänyt.
17 §
Muutoksenhakukielto
Päätökseen, jolla tuomioistuinsovittelu aloitetaan, tuomioistuinsovittelua koskeva pyyntö hylätään tai tuomioistuinsovittelu todetaan päättyneeksi, ei saa hakea muutosta.
3 luku
Tuomioistuimen ulkopuolisessa sovittelussa tehdyn sovinnon vahvistaminen täytäntöönpanokelpoiseksi
18 §
Tuomioistuimen ulkopuolinen sovittelu
Tässä laissa tuomioistuimen ulkopuolisella sovittelulla tarkoitetaan sopimuksen, sääntöjen tai muun vastaavan järjestelyn perusteella toimitettua jäsenneltyä menettelyä, jossa riita-asian osapuolet pyrkivät itse vapaaehtoisesti ratkaisemaan riitansa sovinnollisesti sovittelijan avustuksella.
Lain säännöksiä ei sovelleta menettelyyn, jonka tarkoituksena on, että sovittelija tekee asiantuntijana päätöksiä tai ratkaisusuosituksia riippumatta siitä, ovatko sanotut päätökset tai suositukset osapuolia sitovia.
Edellä 1 momentissa tarkoitetaan:
1) riita-asialla sellaista siviili- tai kauppaoikeudellista asiaa, jossa sovinto on sallittu;
2) sovittelijalla sovitteluun koulutettua henkilöä, joka hoitaa sovittelutehtäviä joko yksityisesti tai sovittelupalveluja tarjoavan organisaation palveluksessa;
3) sovinnolla tuomioistuimen ulkopuolisessa sovittelussa tehtyä kirjallista sopimusta, jonka riita-asian osapuolet ovat allekirjoittaneet ja jonka sovittelija on allekirjoituksellaan vahvistanut.
Tuomioistuimen ulkopuolisessa sovittelussa tehtyä sopimusta lapsen huoltoa, tapaamisoikeutta tai elatusta koskevassa asiassa ei voida vahvistaa täytäntöönpanokelpoiseksi tässä luvussa säädetyssä menettelyssä.
19 §
Sovinnon sisältö
Sovinnosta, jota haetaan vahvistettavaksi täytäntöönpanokelpoiseksi, on käytävä ilmi:
1) sovinnon osapuolet;
2) sovinnon kohteena oleva asia;
3) sovinnon sisältö;
4) sovittelija.
20 §
Sovinnon vahvistaminen täytäntöönpanokelpoiseksi
Käräjäoikeus voi vahvistaa tuomioistuimen ulkopuolisessa sovittelussa tehdyn sovinnon tai sen osan täytäntöönpanokelpoiseksi. Asia pannaan vireille käräjäoikeuden kansliaan toimitettavalla kirjallisella hakemuksella.
Hakemuksen voivat tehdä sovinnon osapuolet yhdessä taikka yksi tai useampi osapuoli muiden osapuolten nimenomaisella suostumuksella.
Hakemuksessa on ilmoitettava hakijan pyyntö sovinnon vahvistamiseksi sekä millä perusteella tuomioistuin on toimivaltainen, jos toimivalta ei muutoin ilmene hakemuksesta tai siihen liitetyistä asiakirjoista. Hakemuksessa on lisäksi soveltuvin osin ilmoitettava oikeudenkäymiskaaren 5 luvun 2 §:n 2 ja 3 momentissa tarkoitetut tiedot.
Hakemukseen on liitettävä:
1) sovintosopimus;
2) tarvittaessa oikeaksi todistettu käännös sovintosopimuksesta suomeksi tai ruotsiksi, jollei tuomioistuin myönnä tästä poikkeusta;
3) tarvittaessa muiden sovinnon osapuolten kirjallinen suostumus sovinnon vahvistamiseen;
4) jäljennös sovittelua koskevasta kirjallisesta sopimuksesta tai muu vastaava selvitys, josta ilmenee sovittelumenettelyn olleen 18 §:n 1 momentin mukainen.
21 §
Toimivaltainen tuomioistuin
Tässä luvussa tarkoitettu sovinto voidaan vahvistaa täytäntöönpanokelpoiseksi käräjäoikeudessa, jonka tuomiopiirissä sovinnon osapuolella on kotipaikka tai vakituinen asuinpaikka. Jos kenelläkään osapuolella ei ole kotipaikkaa tai vakituista asuinpaikkaa Suomessa, toimivaltainen tuomioistuin on Helsingin käräjäoikeus.
22 §
Asiakirjajulkisuus
Tuomioistuimen ulkopuolisessa sovittelussa tehdyn sovinnon täytäntöönpanokelpoiseksi vahvistamista koskevassa menettelyssä annettavien asiakirjojen ja sovintosopimuksen julkisuuteen sovelletaan soveltuvin osin, mitä oikeudenkäynnin julkisuudesta yleisissä tuomioistuimissa annetussa laissa säädetään.
23 §
Este sovinnon vahvistamiselle
Sovintoa ei saa vahvistaa täytäntöönpanokelpoiseksi, jos se on lain vastainen tai selvästi kohtuuton taikka jos se loukkaa sivullisen oikeutta. Sovintoa ei myöskään saa vahvistaa, ellei sitä voida panna täytäntöön siten kuin ulosottokaaressa (705/2007) säädetään.
24 §
Muutoksenhaku
Tuomioistuimen ulkopuolisessa sovittelussa tehdyn sovinnon täytäntöönpanokelpoiseksi vahvistamista koskevaan päätökseen saa hakea muutosta siten kuin muutoksenhausta asianomaisen tuomioistuimen tuomioon säädetään.
25 §
Tuomioistuinsovittelu muussa Euroopan unionin jäsenvaltiossa
Säännöksiä tuomioistuimen ulkopuolisessa sovittelussa tehdyn sovinnon vahvistamisesta täytäntöönpanokelpoiseksi sovelletaan soveltuvin osin myös toisessa Euroopan unionin jäsenvaltiossa tämän lain 2 luvun menettelyyn rinnastuvassa tuomioistuinsovittelussa tehtyyn sovintoon.
26 §
Asian käsittely
Sovinnon täytäntöönpanokelpoiseksi vahvistamista koskevan asian käsittelyyn sovelletaan muutoin mitä hakemusasioiden käsittelystä oikeudenkäymiskaaren 8 luvussa säädetään.
4 luku
Yhteiset säännökset
27 §
Sovittelun kustannukset
Osapuoli vastaa tuomioistuinsovittelusta hänelle aiheutuneista kustannuksista itse.
Osapuoli ei voi soviteltavana ollutta asiaa koskevassa oikeudenkäynnissä vaatia vastapuolelta korvausta hänelle tuomioistuinsovittelusta tai tuomioistuimen ulkopuolisesta sovittelusta aiheutuneista kuluista.
28 §
Maksut
Asian sovittelemista tai sovinnon täytäntöönpanokelpoiseksi vahvistamista tämän lain mukaisesti tarkoittavan hakemuksen tai pyynnön käsittelemisestä perittävistä maksuista säädetään tuomioistuinten ja eräiden oikeushallintoviranomaisten suoritteista perittävistä maksuista annetussa laissa (701/1993).
29 §
Voimaantulo ja siirtymäsäännökset
Tämä laki tulee voimaan 21 päivänä toukokuuta 2011.
Tällä lailla kumotaan riita-asioiden sovittelusta yleisissä tuomioistuimissa annettu laki (663/2005).
Ennen tämän lain voimaantuloa vireille tulleisiin tuomioistuinsovitteluihin sovelletaan lain voimaan tullessa voimassa olleita säännöksiä. Säännöksiä tuomioistuimen ulkopuolisessa sovittelussa tehdyn sovinnon vahvistamisesta täytäntöönpanokelpoiseksi sovelletaan lain voimaantulon jälkeen tehtyihin sovintoihin.

Laki oikeudenkäymiskaaren 17 luvun 23 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan oikeudenkäymiskaaren 17 luvun 23 §:n 1 momentin 4 kohta ja 4 momentti, sellaisina kuin ne ovat laissa 571/1948, sekä lisätään 17 luvun 23 §:n 1 momenttiin, sellaisena kuin se on laissa 571/1948, uusi 5 kohta seuraavasti:
17 luku
Todistelusta
23 §
Todistaa ei saa:
4) asiamies tai oikeudenkäyntiavustaja siitä, mitä päämies on hänelle asian ajamista varten uskonut, ellei päämies todistamiseen suostu;
5) riita-asioiden sovittelusta ja sovinnon vahvistamisesta yleisissä tuomioistuimissa annetussa laissa (394/2011) tarkoitettu sovittelija tai sovittelijan avustaja riita-asiassa siitä, mitä hän tehtävässään on saanut tietää soviteltavasta asiasta, jolleivät erittäin tärkeät syyt vaadi, että häntä siitä kuulustellaan, tai se, jonka hyväksi vaitiolovelvollisuus on säädetty, todistamiseen suostu.
Mitä 1 momentin 1 ja 3—5 kohdassa on sanottu, noudatetaan, vaikkei todistaja enää ole siinä asemassa, jossa hän on saanut tiedon todistettavasta seikasta.
Tämä laki tulee voimaan 21 päivänä toukokuuta 2011.
Tätä lakia sovelletaan lain voimaantulon jälkeen vireille tulleissa oikeudenkäynneissä.

Laki velan vanhentumisesta annetun lain 11 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan velan vanhentumisesta annetun lain (728/2003) 11 §:n 1 ja 2 momentti, sellaisena kuin niistä on 1 momentti osaksi laissa 428/2010, seuraavasti:
11 §
Oikeudelliset katkaisutoimet
Velan vanhentuminen katkeaa niin kuin 2 momentissa säädetään, jos:
1) velkoja panee vireille saatavaa koskevan kanteen velallista vastaan tai esittää saatavaa koskevan vaatimuksen tuomioistuimessa, kuluttajariitalautakunnassa tai laissa säädetyssä muussa toimielimessä tai menettelyssä, jossa voidaan antaa ratkaisu tai ratkaisusuositus, taikka toimielimessä, joka on merkitty Euroopan komission pitämään tietokantaan kuluttajariitoja ratkaisevista elimistä;
2) velkoja ilmoittaa saatavan velallista koskevan julkisen haasteen johdosta taikka velallisen konkurssissa tai muussa maksukyvyttömyysmenettelyssä tai kun velka muutoin otetaan huomioon menettelyn yhteydessä;
3) velkoja panee vireille ulosottoasian tai jos velka muutoin otetaan huomioon ulosottomenettelyssä; tai
4) saatava otetaan käsiteltäväksi tuomioistuinsovittelussa tai sellaisessa sovittelumenettelyssä, jossa tehty sovinto voidaan vahvistaa täytäntöönpanokelpoiseksi siten kuin riita-asioiden sovittelusta ja sovinnon vahvistamisesta yleisissä tuomioistuimissa annetussa laissa (394/2011) säädetään.
Kun 1 momentin 1 tai 3 kohdassa tarkoitettu asia tulee vireille, kun tehdään päätös 2 kohdassa tarkoitetun menettelyn aloittamisesta tai kyseistä velkaa koskevasta väliaikaisesta kiellosta taikka kun tehdään päätös tai sopimus 4 kohdassa tarkoitetun sovittelun aloittamisesta, vanhentuminen keskeytyy menettelyn ajaksi. Vanhentuminen katsotaan katkenneeksi sinä päivänä, jona lainvoimaiseksi tullut tuomio on annettu tai asian käsittely on muutoin päättynyt.
Tämä laki tulee voimaan 21 päivänä toukokuuta 2011.
Tätä lakia sovelletaan myös velkaan, jonka peruste on syntynyt ennen tämän lain voimaantuloa.
